A Tribunal for Kenya: the Waki Commission Report

The Waki commission, charged with the task of investigating post-election violence in the aftermath of the Kenyan elections last December, has called for a special tribunal to try various perpetrators. The Commission of Inquiry into Post-Election Violence, headed by Justice Philip Waki, released its findings on October 15 after a three month investigation. It recommended that a special tribunal be created to "seek accountability against personas bearing the greatest responsibility for crimes, particularly crimes against humanity, relating to the 2007 General Elections in Kenya."

At first glance, one is struck by a gaping omission by the Waki inquiry. Political violence, as pointed out by Human Rights Watch, has plagued the Mt. Elgon district in Kenya's Western Province for two years. Mt. Elgon remains a flashpoint of political angst and acrimony. Avoid that, it would seem, at your peril. This is something the authors of the Waki report do.

Notwithstanding that, the findings of the report make essential, if dire reading. In the first place, the violence that took place last year was the result of a pattern dating back to the last decade. The tribal explosion in the Tinderet division of Nandi District on October 29, 1991 is the first that comes to mind. 1997 was another bad year for tribal clashes, notably in the Rift Valley.

All sides, the report found, had fanned the dispute, funding and indulging in attacks on supporters of their opponents with impunity. This is a pattern the authors of the report are keen to halt through a legal process. A police force criticised by various human rights organizations was also condemned for its use of excessive force against protesters.

In the absence of a special tribunal, the Waki commission has recommended that a sealed list of suspects be turned over to the International Criminal Court in the Hague. While that is a measure of last resort, it would also be a measure of minimal relevance to the complex political landscape of Kenya. The remedial measures of justice should start at home - local and national tribunals are often more desirable than international ones, though an international body may be needed in extreme cases.

Reaction varied, but Nairobi's The Nation breathed a sigh of relief, claiming that Kenya had been offered "a last chance to liberate itself from the slavery of politically-instigated barbarity". Kenya's Daily Nation noted the necessity of a "police shake-up," and overall of the entire system of law enforcement.

The debate may well be had, and the recipient of this report, President Mwai Kibaki, will do well to heed its recommendations. Grievances must be sorted; crimes punished. Georgette Gagno, Africa's director at Human Rights Watch has warned against ignoring the Waki recommendations. "It is Kenyans who will pay the price of future violence if politicians allow this important report to become just another unheeded warning." The unheeded warning may be the epitaph of an entire political process.

Waki to be treaded carefully

This report is not bad. But some people in the rift valley feel the report was just from one community. That nobody was asked any question by the waki team. The report was from the kikuyu ethnic group only. No kalenjin was questioned .

It is time Kenyans took the bull by its horns and sort out the underlying issues that make our society so volatile. No report will be 100% and in this view, let us operationalise the recommendations of both Waki & Kriegler reports and seek self healing as a nation. It is time Kenyans and by extention Africans agree that we are tired of being the underdogs in the International Arena. And we can not change this unless we cement a cohesive society. No amounts of investments will hasten our development when we are still so restless and any progress made will be fickle as we saw early this year.

Democracy and free will thrive in societies that have learnt to differ without creating wide schims amongst its people. The report may expose certain ugliness about ourselves but before we know how bad we are, we must face it then seek recorrective measures.

Next election is not far, let us not hide behind the semblence of peace we have now to thwart the efforts of these two commissions. The world has too many problems to be constantly babying African man made issues!

Waki report is to some extent good but this country has a store of commissions findings and reports which are gathering dust in state house, so if this report is to be implemented then we should begin with all the past reports coz even the constitution is not fully implemented. This report is hard to just implement without looking at other factors which may lead us back to violence this is because it may appear to some as if all their leaders are being "targeted" politically.

IS IT A WAKI’S REPORT OR A WAKI’S JUDGMENT?

The Waki report needs to be investigated before implemented. The issue should not be the implementation of the report but a preview of the social economic damage it might cause if implemented as proposed by the commission. The Waki report is too dictatorial forgetting the humanity aspect of any report that concerns people and personalities. I am not parting with the perpetrators of violence but I would respect a report that is all accommodating and respecting other institutions and personalities. I would respect a report that gives space for the accused to be interrogated to find out if the compilation and accusations are true. If Waki required time he could have asked for more time.
By fact that some people were mentioned in the report does not unless or otherwise pass hash verdicts on the same individuals. Waki as a lawyer should have used the professional ethics in safeguarding the identities and save the country from drifting to where it was in January.
I’m recording my surprise against some Kenyans and religio_ political leaders for being too haste in saying the Waki report should be implemented without considering gab and damage the implementation might coast Kenyans. Some people are using the partial Waki report to criminalize others to achieving their political apexes.
I have a question to Waki, how and why can we mistrust our institutions and rush to Hague?
Let Kenyans ignore the Waki report and embark on what can build Kenya from the shape it incurred after the post election violence. If it is being taken to Hague, let all Kenyans be taken there because everybody I feel was involved including the president and the prime minister.
Waki wants to please the world at the expense of the reputation of some innocent Kenyans. Waki should know that we need each other for personal and collective growth. It is time out to live and operate on speculations gathered and written in a book THE WAKI REPORT just to kill the ambition of others without cause.

IT MUST BE IMPLEMENTED

If this report is ignored we will blame ourselves later since we always have good reasons to ignore them for the sake of the rich big fish. Since their names are in that report they are blaming it to be a wrong, but the time when real deadly violence will be realized they will fly out with their families.
Politicians must not make be allowed do discuss the report, let it be taken to international court, these greedy rich people must pay the price.
If Ndungu's report was implemented we might not have had the violence after previous election.

They have their ambitions which they are after and do not care about others, this kind of people do not have our countries well bieng in them, they own big chanks of land and can never share it with the IDPS. This will regenerate into war between the wealthy and the poor in one of our regions and will be the darkest day for the corrupt wealthy class, it will be time to pay back. So we have to stop ignoring reports when they do not fevour the wealthy, they are the ones who advice the poor youth to kill others, what of if it were that the rich had been affected and the poor Kenyans are the suspects, they would have taken them to court and even denied them a chance to defend themselve.

Im very much concerned about the many poor people who lost their innocent loved ones.These people voted for peace and unity in our country only to end up finding out that they voted for trouble.We trusted these people whom we voted for but they turned against us and became unfaithful ending up inciting violence in our country.These people should face the report if they really think they are innocent and didnt participate in the incitements.It is a high time that the Government stops misusing our funds in appointing these commisions and not telling Kenyans the real truth becvause we pay taxes and yet what we give is used to enrich others without seing the benefits.We need these reports;Kriegler's and Waki's report fully implimented after it's revision n the necessary action taken.

Waki commission is another failed judicial inquiry process. All Kenyans know what resulted into the violence. These are just political cover ups. In actual sense. leaders must be forced to take responsibility.

The electoral process was evidently flawed; in fact when the presidency itself as an institution is mentioned to have participated in engineering electoral flaws then a commission appointed by the same institutions and that hands over the report to the very people who ought to be investigated then this is a pointer to difficult moments ahead.

Kenyans must reject political public relations gimmicks. Neither Raila nor Kibaki has the guts to implement the findings. It was a failure before it made any enquiry. May be ICC will save us.

It is very disturbing to have some people saying that no report is accurate , of course, but most are surely a true reflection of what happens in Kenya and can therefore be regared as a proper judicial inquiry process.
